Terms of Service, Client Disclaimer & Informed Consent

YOURSELF CENTER —v3

1. Who We Are

These Terms of Service ("Terms") are issued by Yourself Center, a business registered in Hong Kong under Business Registration No. 41676515-000-06-26-7, with its registered address at Hong Kong, as "YOURSELF CENTER" ("we", "us", "our").

These Terms apply whenever you book, register for, or attend any session, workshop, or service with us, whether in-person or online. .

Please read these Terms carefully before booking. By booking or attending a session, you confirm that you have read, understood, and agreed to them.

2. Nature of Our Services

We provide therapeutic, coaching, healing, and well-being services intended to support personal growth, emotional well-being, self-awareness, resilience, and holistic development. Depending on the service you choose, a session may include one or more of the following:

•     Hypnotherapy

•     EFT – Emotional Freedom Technique

•     Energy healing (e.g. Reiki, magnetism/magnetic healing)

•     Integrative therapeutic approaches

•     Mindfulness and meditation

•     Somatic awareness techniques

•     Breathwork (where appropriate)

•     Spiritual and intuitive guidance

•     Trauma-informed well-being practices

•     Stress management

•     Personal development coaching

Not all of these services are regulated psychotherapy or healthcare. Energy healing, spiritual guidance, intuitive work, and other holistic practices are complementary well-being practices. They are intended to support general well-being and are not recognized medical treatments.

3. This Is Not Medical, Psychiatric, or Emergency Care

Our services do not include and must not be treated as:

•     Medical or psychiatric diagnosis

•     Medical or psychological treatment

•     Psychological testing

•     Emergency mental health care

•     Prescription or adjustment of medication

•     Legal advice

•     Financial advice

Nothing said in a session replaces advice or treatment from a physician, psychiatrist, psychologist, or other licensed healthcare professional. Please continue to seek appropriate medical care for any physical or mental health condition, and never stop or change medication or medical treatment without first speaking to your treating healthcare provider.

4. Complementary and Holistic Practices — No Guaranteed Outcomes

Energy healing, intuitive work, spiritual guidance, meditation, and related holistic practices are complementary well-being approaches. They:

•     are not scientifically proven treatments

•     may not produce any specific outcome

•     should never be understood as medical treatment or a replacement for evidence-based healthcare

•     may involve subjective personal experiences that vary from person to person

We do not claim to treat, cure, alleviate, or prevent any diagnosed medical condition — including, without limitation, cancer or any other serious illness — through hypnotherapy, magnetism, or any other energy or holistic practice offered by us. Any general sense of well-being that clients report is anecdotal, individual, and never guaranteed. Our services are offered in addition to, and never as a substitute or exclusion for, conventional medical care.

We make no representations or warranties regarding healing, recovery, symptom reduction, financial improvement, relationship outcomes, spiritual experiences, or personal transformation. Testimonials reflect one person's individual experience and do not guarantee that you will have a similar result.

5. When We May Not Be Able to Work With You

Some of our services, particularly hypnotherapy and EFT, are not suitable in every situation. We may decline or pause sessions where, for example:

•     You are currently taking anti-depressant or other psychiatric medication where the technique could interact with your treatment, without your treating doctor's awareness and agreement

•     You have a diagnosis such as schizophrenia, bipolar disorder, severe cognitive impairment, a brain-related illness, or you are experiencing acute psychosis

•     You are not willing or able to engage actively in the session

If you are booking on behalf of someone else (for example, a family member), please make sure that person — or their legal guardian(s) or carer(s), if they cannot give consent themselves — has given full, informed consent before you book. I also need the child assent in a way that fits the child age.

6. Your Responsibilities as a Client

•     You are responsible for your own decisions and actions.

•     Your participation is entirely voluntary, and you may stop any exercise or technique at any time.

•     Please tell us if you feel any discomfort during a session.

•     You remain responsible for seeking medical or psychological care where needed, alongside our work together.

•     Lasting change depends on many factors outside our control, and we cannot guarantee any particular result.

7. Health Information You Must Tell Us

Please tell us about any medical, psychological, or psychiatric condition that may affect our work together, including:

•     Serious mental illness or psychosis

•     Bipolar disorder

•     Suicidal thoughts

•     Substance dependence

•     Neurological disorders

•     Pregnancy (where relevant)

•     Any significant physical health condition

•     You take prescribed medication for your mental health such as antidepressants for example.

This information helps us decide whether our services are appropriate for you and is treated as sensitive personal data under Section 15 (Data Protection & Privacy) below.

Typically we do not recommend hypnotherapy if you suffer from any of above mental issues.

8. Crisis and Emergency Situations

We are not an emergency service and do not provide 24-hour crisis support. If you are experiencing suicidal thoughts, thoughts of harming yourself or others, severe psychiatric symptoms, a medical emergency, or any situation needing immediate help, please contact your local emergency services, go to your nearest emergency department, or contact a crisis line immediately.

Email, messaging apps, and voicemail must never be used to reach us in an emergency, as we cannot guarantee we will see the message in time.

9. Practitioner Qualifications and Professional Standing

Hypnotherapy, energy healing, and related holistic practices are not statutorily licensed or regulated professions in Hong Kong, the UK, or most EU jurisdictions, and we do not claim to hold a medical, psychiatric, or psychological license.

If you are based in the EU, please note that a small number of member states (for example, Germany and Austria) restrict who may lawfully offer psychotherapy-adjacent services to local residents. If you have any doubt about whether local rules apply to you, please check with your local authority before booking.

10. Booking, Fees and Payment

Your booking is confirmed only once we receive full payment. Until then, your slot remains available to other clients.

Prices are shown in HKD (Hong Kong Dollar) and are inclusive of any applicable tax. Payment is due immediately when you book a session, gift card, or other service (such as home or office energy cleansing). Payment is made by bank transfer only, following the instructions sent to you by WhatsApp and email after booking. Because bank details and health information may be shared over WhatsApp, please treat these messages as confidential and avoid sharing your device with others; see Section 15 for how we handle this.

All payments are declared in accordance with Hong Kong law, and an invoice or receipt is available to you on request.

Extra charges apply for in-person sessions. Charges will be confirmed together with the clinic address when you contact me.

11. Your Right to Cancel (Cooling-Off Period)

If you are booking as a consumer from the United Kingdom or the European Economic Area and you book remotely (for example, through our website, WhatsApp, or email), you normally have a legal right to cancel within 14 days of booking without giving a reason, under the UK Consumer Contracts Regulations 2013 or the equivalent EU Consumer Rights Directive.

If you would like your session to take place within that 14-day period, we will ask you to expressly confirm that you want the service to begin straight away and that you understand you may lose the right to cancel once the session has been delivered. This cooling-off right is separate from, and additional to, the 24-hour cancellation policy in Section 12 below.

12. Cancellations and Refunds

Cancellation policy

Please cancel at least 24 hours before your scheduled session. If you cancel with less than 24 hours' notice, the session is not refundable, but you may reschedule the same session to a new time at no extra cost, provided you do so at least 24 hours ahead of the original session.

Refunds

Sessions and workshops are otherwise non-refundable, including for no-shows or partial attendance, except where:

•     There has been a medical emergency, supported by evidence such as a health report or doctor's note; or

•     We cancel your session.

This section does not affect your cooling-off right under Section 11, where it applies.

13. Transferring a Gift Card or Session

A gift card may be used by anyone you nominate once it has been paid for and a session has been booked using it. A session you have already paid for may also be transferred to someone else if you give us written instructions to do so.

14. Confidentiality

We treat what you share with us as confidential. We will not disclose your personal information or the content of your sessions to anyone outside our practice, except:

•     Where you give us written consent to share it;

•     Where we are required to do so by law or a court order; or

•     Where we believe, in good faith, that there is a serious risk of harm to you or to another person, in which case we may need to contact emergency services or another appropriate authority.

In group workshops, other participants may share personal and sensitive information about themselves. By attending, you agree to keep whatever you hear from other participants confidential, and to help create a safe, respectful space for everyone.

15. Data Protection and Privacy

We collect and use your personal data, including sensitive health-related information, in order to provide our services safely and to manage your booking and payment.

What we collect and why

•     Contact and booking details (name, email, phone) — to manage your booking and communicate with you.

•     Payment records — to process payment and issue invoices, as required by Hong Kong law.

•     Health, psychological, and psychiatric information you disclose to us — to assess whether our services are suitable for you and to deliver them safely.

Legal basis (for clients in the UK/EEA)

Health-related information is "special category data" under the UK/EU GDPR. We only process it with your explicit consent, which you give by disclosing this information to us and confirming your agreement in Section 30 (Your Consent).

Sharing and storage

We do not sell your personal data. It may be shared with service providers we use to run our practice (for example, messaging or payment platforms such as WhatsApp/Meta, which may process data outside Hong Kong, the UK, or the EEA). We keep client records only for as long as needed to provide our services and to meet our legal and professional obligations— typically no longer than 3 years after last session/workshop, after which they are securely deleted.

Your rights

Subject to applicable law, you may ask us for a copy of the personal data we hold about you, ask us to correct it, ask us to delete it, or withdraw consent for us to process health-related data (which may affect our ability to continue seeing you). Hong Kong clients can raise concerns with the Office of the Privacy Commissioner for Personal Data; UK clients with the Information Commissioner's Office; and EEA clients with their local data protection authority.

This section applies in addition to, and does not replace, the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong, the UK GDPR, and the EU GDPR, each as applicable to you. It covers information collected in order to deliver our services to you; it does not cover cookies or tracking technology on our website, which is addressed separately in Section 29.

16. Photography, Recording and Marketing

We do not photograph, film, or record sessions or workshops, or use your name, image, or story in marketing materials or testimonials, unless you give us separate, specific written consent to do so. You may withdraw that consent at any time by contacting us, and we will stop any new use of your image or story from that point onward.

17. Intellectual Property

All workshop materials — including slides, handouts, videos, and recordings — belong to YOURSELF CENTER. You may use them for your own personal purposes only, and may not reproduce, distribute, or share them without our written permission.

18. Age and Capacity to Consent and assent

Our services are offered to adults aged 18 and over. If you wish to book a session for someone under 18, or for an adult who is unable to give informed consent themselves, this requires the prior written consent of their parent(s) or legal guardian(s), given directly to us before the booking is confirmed. We reserve the right to decline any booking made on behalf of a minor without this consent. I also need the child assent in a way that fits the child age.

19. Online Sessions

•     Internet connections may occasionally fail, and we are not responsible for technical issues on your side, including connectivity, hardware, or software problems.

•     We cannot absolutely guarantee the confidentiality of electronic communications.

•     Please make sure you are in a private location for your session.

•     Please do not record sessions unless both parties have agreed to this in writing beforehand.

20. Professional Boundaries

Our relationship with you is a professional one. To keep it ethical and effective, sessions take place only through agreed communication channels, we may not accept contact through personal social media, we generally avoid personal relationships outside of our therapeutic work, and we may decline gifts or other exchanges that could compromise professional boundaries.

21. Behavior and Participation

By booking, you confirm you are attending at your own free will. We expect everyone to engage respectfully and professionally. Disruptive behavior, harassment, or discrimination of any kind will not be tolerated and may result in immediate removal from a session or workshop without a refund.

22. Our Right to Decline or End a Booking

We may decline a booking, or end our work together, where we reasonably believe our services are not appropriate for you (see Section 5), where we identify a conflict of interest, or for any other legitimate business reason. Where we do this before a session has taken place, we will refund any payment already made for that session.

23. Limitation of Liability

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited under the law of Hong Kong, the UK, or the EU.

Subject to the paragraph above, and to the fullest extent permitted by law, we are not liable for indirect or consequential loss arising from your participation in a session or workshop. You take part on the understanding that outcomes are not guaranteed (see Section 4), and that you remain responsible for your own decisions and for seeking appropriate medical or psychological care alongside our work together.

24. Force Majeure

We are not responsible for delays or cancellations caused by events outside our reasonable control, such as natural disasters, severe weather warnings (e.g. Black Rainstorm or Typhoon Signal No. 8 and above), fire, strikes, pandemics, or government restrictions. Where this happens, we will let you know as soon as possible and offer to reschedule your session.

25. Complaints

If you are unhappy with any aspect of our service, please contact us first at contact@yourselfcenter.org so we can try to resolve it directly. Hong Kong clients may also contact the Consumer Council; UK clients may contact Citizens Advice or Trading Standards; EEA clients may contact their national consumer protection body.

26. Governing Law and Jurisdiction

These Terms are governed by the laws of Hong Kong SAR, and the courts of Hong Kong have non-exclusive jurisdiction over any dispute arising from them. If you are a consumer habitually resident in the UK or the EEA, this choice of law does not take away any protection you are given by the mandatory consumer laws of your own country, which continue to apply alongside these Terms.

27. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in the law or in our services. We will give you at least 14 days' notice of any material change by email or by posting a notice on our website before it takes effect. Continuing to book sessions after that point means you accept the updated Terms.

28. General

If any part of these Terms is found to be unenforceable, the rest will remain in full effect. These Terms, together with any specific booking confirmation, form the whole agreement between you and us regarding our services.

These Terms are issued in English. If we ever provide a translated version, for example in French, the English version prevails in the event of any conflict or ambiguity.

29. Website, Cookies and Other Policies

These Terms govern the services we provide to you as a client. Our website may separately use cookies or similar tracking technology for analytics or functionality; where required under UK or EU law (the Privacy and Electronic Communications Regulations / ePrivacy Directive), details of this are set out in a separate Cookie Policy on our website, not in this document.

30. Your Consent

By booking or attending a session or workshop with us, you confirm that:

•     You have read this document in full and understand it.

•     You understand the nature and limitations of the services we provide.

•     You have had the chance to ask questions before proceeding.

•     You freely and voluntarily consent to take part, and understand you may withdraw that consent at any time.

•     You consent to our collection and use of your personal and health-related data as described in Section 15.

•     You accept responsibility for your own decisions and well-being throughout our work together.
